Farmers Insurance – Class Action Lawsuit Against Farmers

In 2021, an individual filed a class-action lawsuit against the largest dairy cooperative in the United States. The complaint claimed that the farmers had been victims of a litigious campaign by the Insurance Company of America, or more specifically, the Insurance Company of America (ANI). The complaint alleged that the Insurance Company of America, which is now known as Allstate, had engaged in a “concerted enterprise” with certain other insurance companies to exclude certain farmers from providing adequate coverage for their premiums. The complaint further claimed that the Coverage policy was issued based on an arbitrary and subjective basis. As a result, the claim alleged that the Coverage policy denies claims based on health status, occupation, medical history, and the amount of money that the farmer has invested in the farming business. The case ultimately was settled in favor of the defendant, however, the insurance carrier has yet to admit liability.

Similar to the above example, another case was filed against the Insurance Company of America (OCC), better known as Allstate, which is a nationwide insurance provider.

In this case, a class-action lawsuit was brought against Allstate, which was accused of being negligent in its underwriting practices when it comes to insurance policies for farmers. This case ultimately was settled in favor of the plaintiff. In addition to being guilty of breach of contract and unfair and deceptive business practices, Allstate was also found guilty of imposing unreasonable premiums. These claims were ultimately ruled in favor of the plaintiffs.

Other class-action lawsuits have also been filed against insurance providers for their actions when it comes to denying claims for personal injuries sustained while at work. In one case, a lawsuit was filed against Travelocity, claiming that the travel discount giant discriminated against members of a class because of their disability. Travelocity eventually agreed to settle the case, paying out over a million dollars in refunds and settlements to over thirteen thousand members of the disabled community.

Other claims of discrimination have been lodged against large corporations like J.D.

Powers and Associates, Inc. and The Dow Chemical Company for their policies regarding the handling of fertilizers and pesticides. In both of these cases, it was determined that the plaintiffs had a substantial percentage of valid claims for personal injuries or accidents at work related to these chemicals. Class-action lawsuits are designed to give ordinary people a voice; these lawsuits allow everyday people with legitimate complaints to stand up in court against powerful companies that want to maintain their power and dominance over the economy.

Farmers are another group that could potentially benefit from a successful class-action lawsuit. During the time of the housing crash, many farmers lost their jobs or had their hours cut back. As these families struggled to pay off their mortgages and other expenses, they became trapped in sub-prime loans with adjustable interest rates that soon skyrocketed to unbelievable levels. Thanks to the efforts of a class-action lawsuit brought by Green and Kennedy Law, these families were able to receive financial assistance from the mortgage lenders and Citigroup to save their homes and pay down their debts. Even though the Obama administration and the Federal Housing Administration tried to wave the issue off as a technical issue concerning consumer protection, these families and others who suffered losses in this economic disaster will never be the same.
